Terms and Conditions
Effective date: October 22, 2025
1) Scope
These Terms and Conditions apply to all users of Blanchard Telephone services, including copper wireline, fiber, DNS, DSL, VDSL, SIP, VoIP, web hosting, and dedicated circuits. “Customer” means the person or organization that orders or uses the services.
2) Term and Renewal
By signing a Service Order, the Customer agrees to these Terms. The initial term begins on the service activation date shown on the first bill and runs for the length stated in the Service Order. Unless the Customer gives written notice at least 90 days before the end of the current term, the agreement renews for consecutive 24-month terms. Rates at renewal update to then-current pricing.
3) Billing and Pricing

Charges include monthly recurring charges and any one-time charges. Bills are issued on a 30-day cycle. All amounts are due by the date shown on the statement.

Initial bills may include installation and equipment charges. Later bills may reflect changes the Customer requested. Changes in monthly recurring charges can take one or two billing cycles to appear.

Late payment fees may apply. Delinquent accounts may be charged reconnection fees. If service is terminated for nonpayment, early termination fees can apply.

If the Consumer Price Index for All Urban Consumers increases more than 2.0% over the prior 12 months, Blanchard may apply a CPI adjustment up to the unadjusted 12-month CPI amount once in a 12-month period, including during a term, unless prohibited by law.

Month-to-month rates may change with written notice by mail or electronic means. Contracted term plans are exempt from month-to-month rate changes, except CPI adjustments if applicable.

Taxes, regulatory fees, and surcharges apply.
4) Termination
Either party may terminate for cause with written notice. The notice must describe the issue and allow 30 days to cure. If not cured, termination becomes effective after the 30-day period. Blanchard may also terminate as required by tariff or law.
If the Customer terminates during a term, or if Blanchard terminates for cause, the Customer agrees to pay:

Any waived costs or fees incurred to deliver service

Any waived installation or setup fees

Revoked discounts, with month-to-month rates applied retroactively for the term

The full undepreciated list cost of Blanchard-provided equipment that is not returned within 10 business days

Collection costs, including reasonable attorney fees, and a $50 collections processing fee if final payment is over 30 days late
Month-to-month service may be terminated by either party with 30 days’ written notice. Telephone numbers will not be released to another provider until all amounts owed are paid.
5) Equipment
Unless sold to the Customer in writing, all hardware and software that Blanchard provides remains Blanchard property. Blanchard maintains its equipment for ordinary wear and tear. Damage caused by misuse, vandalism, negligence, or third parties is the Customer’s responsibility.
The Customer will provide suitable space, power, and environment, and will protect equipment from damage and surges. The Customer is responsible for connecting its own devices unless otherwise agreed in writing.
Security is the Customer’s responsibility, including firewalls for SIP phones and strong device passwords. Third-party antivirus and spam filtering may be offered, but no guarantee is made that services will be virus or spam free.
6) Access and Credentials
After a Service Order is accepted, Blanchard may issue usernames, passwords, and IDs. These remain Blanchard property and may be updated when needed. The Customer must keep credentials confidential and notify Blanchard of any suspected unauthorized access.
7) Customer Contact and Site Access
By providing phone numbers, the Customer authorizes Blanchard to contact those numbers about the account, which may include calls or SMS, including automated or prerecorded messages where allowed by law.
The Customer grants Blanchard permission to access the premises to install, maintain, inspect, repair, or remove equipment. An adult authorized by the Customer may need to be present for appointments.
8) Intended Use and Acceptable Use
The Customer agrees to follow all laws and Blanchard’s Acceptable Use Policy. Prohibited uses include infringement, unlawful content, harassment, network abuse, or activities that interfere with other users.
Residential or consumer-labeled services may not be used for high-volume or commercial purposes without written consent from Blanchard.
9) IP Addresses
IP addresses are not portable and are not assigned for independent administration. Assignments can change if required by Blanchard or ARIN. Customers may not tamper with IP configurations or those of other customers.
10) Restrictions and Service Limits

Tariffed services are provided under applicable tariffs on file with the Michigan Public Service Commission or the FCC. If a tariff conflicts with these Terms, the tariff controls.

Speeds are not guaranteed. Throughput may vary due to network conditions, configuration, server limits, protocol overhead, or other factors.

The service is for use at a single residence or single business unless otherwise agreed. Resale to third parties is not allowed.
11) Inside Wiring and Installation on Customer Equipment
Installation may require access, inside wiring, or additional equipment. Extra work can result in additional charges. If Blanchard installs hardware or software on Customer devices, Blanchard is not responsible for resulting issues with those devices.
12) Service Availability and Disclaimers
Services are provided on an “as is” and “as available” basis. Blanchard will use reasonable efforts consistent with industry standards, but does not warrant uninterrupted or error-free service. No advice or information creates a warranty.
The internet includes content that Blanchard does not control. Access is at the Customer’s risk. Scheduled and unscheduled maintenance or events outside Blanchard control may cause outages. Outages do not void these Terms.
13) Limitation of Liability
Blanchard is not liable for damage to private infrastructure on Customer property, including sprinkler systems, private electric lines, septic systems, or wells. The Customer is responsible for locating and marking private underground utilities before work begins.
If MISS DIG markings are removed by the Customer or anyone on the property with the Customer’s approval, the Customer will indemnify Blanchard for unintentional damage to underground facilities.
Blanchard is not liable for indirect, special, incidental, or consequential damages, including lost revenue, goodwill, or profits. The Customer’s sole remedy for a service defect is a credit of the pro-rated monthly charge for the affected service, up to one month of service, after Blanchard has been notified and given an opportunity to resolve the issue.
14) Entire Agreement and Changes
These Terms, the Service Order, the Acceptable Use Policy, and any applicable tariff make up the entire agreement and replace prior agreements. Blanchard may update these Terms. The most current version will be posted at [blanchardtel.com/terms]. A printed copy of electronic notices is admissible to the same extent as other business records.
15) Assignment
These Terms bind and benefit each party’s permitted successors and assigns. The Customer may not assign the agreement without Blanchard’s consent, which will not be unreasonably withheld, and only if the account is not delinquent or in breach.
16) Venue and Governing Law
These Terms are governed by the laws of the State of Michigan and the United States. Any claim related to internet service must be filed within one year after it arises.
17) Severability
If a court finds any provision invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be enforced to the fullest extent permitted consistent with the parties’ intent.
18) Indemnification
The Customer agrees to indemnify and hold Blanchard harmless from claims, losses, damages, and liabilities that result from the Customer’s breach of these Terms or the Acceptable Use Policy.
